Terms of Service - Gift Marshal

Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Gift Marshal governing your use of the Gift Marshal mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Eligibility

You must be at least 13 years old to use the App. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

Important: The App does not verify user ages. By using the App, you confirm that you meet the age requirements.

Description of Service

Gift Marshal is a gift coordination platform that allows users to:

Create and manage gift-giving events (birthdays, weddings, baby showers, Secret Santa, etc.)
Create and share wishlists
Claim gifts to help prevent duplicates
Track group gift contributions
Track gift-giving history

Service Limitations

The App is provided as a coordination tool only. We do not:

Guarantee that duplicate gifts will be prevented in all circumstances
Process or handle any payments for gifts or group gift contributions
Verify the identity of users or event participants
Moderate or verify user-generated content

Account Registration and Security

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Ensuring your account information is accurate and up-to-date
Notifying us immediately of any unauthorized use

Account Termination

By You: You may delete your account at any time through the App settings. Upon deletion, your profile, events, and wishlists will be deleted within 30 days.

By Us: We may suspend or terminate your account if you violate these Terms or if we are required to do so by law.

Premium Subscription

One-Time Purchase

Gift Marshal offers a Premium upgrade as a one-time purchase (not a recurring subscription): $9.99 USD (or local equivalent).

Refunds

All sales are final. If you believe you are entitled to a refund, you must request it through Apple at Apple Support.

No Refunds for Service Changes: Premium is a one-time purchase that grants access to enhanced features. You are not entitled to refunds if we modify, reduce, or discontinue features.

User Content

Ownership

You retain ownership of your content. By posting content, you grant us a limited, non-exclusive license to display, store, and process your content to provide the service.

Content Restrictions

You agree not to post content that:

Is illegal, harmful, threatening, abusive, or harassing
Is sexually explicit or pornographic
Promotes violence or discrimination
Infringes on intellectual property rights
Contains malware or malicious code
Impersonates another person or entity
Contains spam or unauthorized advertising

No Content Moderation: We do not proactively monitor or moderate user content. You use the App and view user content at your own risk.

Event Participation

Secret Santa Events

Assignments are generated randomly using cryptographically secure methods
Participants cannot see who has their name (the surprise is protected)
Once names are drawn, wishlist items cannot be deleted

Push Notification Warning: Secret Santa assignment notifications reveal who you are assigned to gift. Notifications may be visible on your lock screen.

Gift Claims

Claims indicate your intent to purchase an item
Claims are visible to other participants (not the recipient)
Claims are not binding commitments — we cannot enforce gift purchases
Duplicate prevention is not guaranteed, especially in offline scenarios

Group Gifts

Critical Disclaimer: The App does NOT handle money or process payments for group gifts. You are solely responsible for collecting money, purchasing the gift, and handling disputes.

Acceptable Use Policy

You agree not to:

Violate any applicable laws or regulations
Attempt to gain unauthorized access to the App or its systems
Reverse engineer, decompile, or disassemble the App
Use the App for commercial purposes without permission
Create fake accounts or events for fraudulent purposes
Harass, bully, or intimidate other users
Abuse the App's infrastructure

Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

We do not guarantee:

Uninterrupted or error-free operation
Prevention of duplicate gifts in all scenarios
That the service will continue indefinitely
Accuracy of external links or product information

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Our total liability shall not exceed the greater of the amount you paid us in the twelve months preceding the claim, or $50 USD.

Dispute Resolution

Informal Resolution

Before filing a legal claim, you agree to try to resolve the dispute informally by contacting us. We will attempt to resolve the dispute within 60 days.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting updated Terms in the App. Your continued use after changes constitutes acceptance.
